As regulated by Federal Law No. 342 – FZ of 3.08.2018 "On Amendments to the Urban Planning Code of the Russian Federation and Certain Legislative Acts of the Russian Federation":
10.2 - non-capital buildings, structures - structures, structures that do not have a strong connection with the ground and whose structural characteristics allow their relocation and (or) dismantling and subsequent assembly without disproportionate damage to the purpose and without changing the main characteristics of buildings, structures (including kiosks, canopies and other similar structures, structures)
- When arbitration courts consider such disputes, in the vast majority of cases, the issue of the "non-capitality" of the disputed object is resolved based on the results of the construction and technical expertise carried out in the case;
- The defining characteristics of a non-capital object are the temporality and the possibility of moving the building (without disproportionate damage to its purpose);
- It is allowed to build non-capital objects of any kind without a construction permit that do not fall under the definition of real estate and do not violate legally established prohibitions;
- Thus, a non-capital object (movable thing) should be understood as a temporary building that does not have a strong connection with the earth, the movement of which is possible without disproportionate damage to its purpose;
